Can I claim diminished value after an accident in Ontario?

Rarely, in Ontario. Because vehicle damage in most Ontario collisions is paid by your own insurance company under DCPD, the usual right to sue the at-fault driver for vehicle damage — including lost resale value — is largely taken off the table. Exceptions exist, mainly collisions outside Ontario or involving vehicles not insured here, and documentation is what keeps them alive.

What diminished value is

Vehicle history reports make accident records permanent, and buyers pay less for a car that has been hit — typically several percent of its value even after a flawless repair, and more on newer or luxury vehicles. The gap between what the car was worth before the collision and what the market pays afterward is diminished value.

Why Ontario is different

In most US jurisdictions, the standard route is a claim against the at-fault driver. Ontario closed most of that road: for a typical collision here between two Ontario-insured vehicles, your damage is paid by your own insurance company under DCPD, and the right to sue the other driver over vehicle damage is largely removed with it. DCPD pays for repair, towing, and loss of use — not for the market discount an accident history creates.

The realistic exceptions sit at the edges: a collision that happened outside Ontario, or an at-fault vehicle that was uninsured or not insured by a company licensed in Ontario. In those situations a claim against the driver may still be open — and the clock matters, because Ontario’s Limitations Act, 2002 gives you two years for property-damage lawsuits.

What to do instead — and what to keep

Whatever your claim path, keep the paper: the final repair invoice, photos of the original damage, and the parts list. A documented, properly executed repair with OEM parts is the strongest answer to a lowball trade-in offer, and it is the foundation of any diminished-value case where one of the exceptions applies.
